1. Acceptance of Terms

By accessing and using Surfside Kids Park facilities, website, or services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service or visit our facilities.

These Terms apply to all visitors, users, and others who access or use our services, including parents, guardians, and children. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. Park Access and Admission

Admission to Surfside Kids Park is subject to payment of applicable fees and compliance with all park rules and regulations. We reserve the right to refuse admission or remove any person from the park for any reason, including but not limited to:

• Failure to comply with safety rules and regulations
• Disruptive, dangerous, or inappropriate behavior
• Violation of dress code requirements
• Being under the influence of alcohol or illegal substances
• Bringing prohibited items into the park

All admission fees are non-refundable except as required by Australian Consumer Law. Season passes and multi-visit tickets are non-transferable and subject to terms and conditions specified at the time of purchase.

3. Safety Rules and Regulations

For the safety of all guests, the following rules must be observed at all times:

• Children under 12 years must be supervised by an adult at all times
• Height, weight, and age restrictions on rides must be strictly observed
• Follow all posted signs and staff instructions
• No running on wet surfaces or in pool areas
• Appropriate swimwear required in water attractions
• No glass containers, alcohol, or outside food and beverages
• Smoking is prohibited throughout the entire park facility
• Personal belongings are left at owner's risk

Failure to comply with safety rules may result in immediate removal from the park without refund.

4. Assumption of Risk and Liability

By entering Surfside Kids Park, you acknowledge and agree that:

• You participate in all activities at your own risk
• Amusement park activities carry inherent risks of injury
• You assume full responsibility for any injury, loss, or damage
• You waive certain legal rights against Surfside Kids Park

While we maintain comprehensive safety measures and regular equipment inspections, we cannot eliminate all risks associated with amusement park activities. Our liability is limited to the extent permitted by Australian law, and we are not responsible for injuries resulting from guest misconduct, failure to follow rules, or pre-existing health conditions.

5. Photography and Media Release

By entering Surfside Kids Park, you consent to being photographed, filmed, or recorded for promotional, marketing, or security purposes. These images may be used in our marketing materials, website, social media, or other promotional activities without compensation to you.

If you prefer not to be included in promotional materials, please notify park staff upon entry. Security cameras operate throughout the facility for the safety and security of all guests.

6. Prohibited Items and Conduct

The following items and behaviors are strictly prohibited:

• Weapons, dangerous objects, or illegal substances
• Glass containers, outside food, or alcoholic beverages
• Professional photography equipment without prior authorization
• Pets or animals (except registered service animals)
• Inappropriate clothing or swimwear
• Harassment, discrimination, or threatening behavior
• Vandalism or damage to park property
• Commercial activities or solicitation

7. Lost and Found Policy

Surfside Kids Park is not responsible for lost, stolen, or damaged personal items. We provide lockers for rent and recommend securing valuables. Lost items may be turned in to our Lost and Found department, where they will be held for 30 days before being donated to charity.

Items of significant value will be held for 90 days. We will make reasonable efforts to contact owners of identified items but cannot guarantee return of lost property.

8. Weather and Closure Policy

Surfside Kids Park reserves the right to close attractions or the entire facility due to weather conditions, maintenance requirements, or other circumstances beyond our control. In case of temporary closures, no refunds will be provided, but rain checks may be issued at management's discretion.

We prioritize guest safety and will suspend operations during severe weather, including lightning, high winds, or heavy rain. Outdoor attractions may close while indoor facilities remain open.

9. Refund and Cancellation Policy

All sales are final unless otherwise required by Australian Consumer Law. Refunds may be considered in the following circumstances:

• Park closure due to mechanical failures lasting more than 4 hours
• Medical emergencies preventing park enjoyment
• Extreme weather conditions resulting in full park closure

Refund requests must be submitted within 7 days of visit with appropriate documentation. Season passes and annual memberships are non-refundable after a 14-day cooling-off period.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By using our services, you consent to the collection, use, and disclosure of your personal information in accordance with our Privacy Policy.

We comply with the Australian Privacy Act 1988 and the Privacy Amendment (Notifiable Data Breaches) Act 2017 in our handling of personal information.

11. Intellectual Property

All content, trademarks, logos, and intellectual property displayed at Surfside Kids Park or on our website are owned by us or our licensors. You may not reproduce, distribute, or create derivative works without our express written permission.

The Surfside Kids Park name, logo, and all related marks are trademarks of Surfside Kids Park Pty Ltd and are protected under Australian intellectual property laws.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Queensland, Australia, and any disputes will be subject to the exclusive jurisdiction of the Queensland courts. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Any disputes arising from these Terms or your visit to Surfside Kids Park will be resolved through binding arbitration in accordance with the rules of the Australian Centre for International Commercial Arbitration.
